Terms of Service & License Agreement

This document, the "Terms of Service", is a legal agreement between you ("you" or "your") and mPaathShaala™ ("we", "us" or "our") in relation to our applications and games ("Software") that are made available via the App Store, Google Play and/or other app stores (collectively "Marketplace") and the services of this website www.mpaathshaala.com ("Website") (together the "Services").

You agree that your use of the Software and/or Services constitutes acknowledgement that you have read the Terms of Service ("Agreement"), you understand them, and you agree to be bound by these terms and conditions.

You agree that you are at least 13 years old and that if you are between 13 years and 18 years old, your legal guardian has reviewed and agrees to these terms and is happy for you to use the Software and/or Services.

We grant you a non-exclusive and non-transferable license to use the Software and/or Services in accordance with the terms and conditions listed here. These Software and/or Services are for your personal use only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Any use of the Software and/or Services in violation of this provision is prohibited.

The right to use the Software/Services is on revocable license / permission basis as per the terms and conditions contained herein. We reserve the right, in our sole discretion, to terminate the license or refuse all or part of our services, for any reason without notice to you.

Use of Software

You may not:

1. modify, translate, reverse engineer, decompile, disassemble (except to the extent that this restriction is expressly prohibited by law) or create derivative works based upon the Software;
2. permit other individuals to use the Software except under the terms listed above;
3. copy the Software (except for back-up or archival purposes);
4. sell, rent, lease, transfer, or otherwise convey rights to the Software;
5. remove any proprietary notices or labels on the Software.

Use of Website

You represent, warrant, covenant and undertake that you shall not host, display, upload, modify, publish, transmit, update or share any information on the Website, that:

1. belongs to another person and to which you do not have any right to;
2. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
3. harm minors in any way;
4. infringes any patent, trademark, copyright or other proprietary rights;
5. violates any law for the time being in force;
6. deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
7. impersonate another person;
8. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
9. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation.

You further represent, warrant, covenant and undertake that your use of the Website shall not:

1. violate any applicable local, provincial, state, national or international law, statute, ordinance, rule or regulation;
2. interfere with or disrupt computer networks connected to the Website;
3. impersonate any other person or entity, or make any misrepresentation as to your employment by or affiliation with any other person or entity;
4. forge headers or in any manner manipulate identifiers in order to disguise the origin of any user information;
5. upload, post, transmit, publish, or distribute any material or information for which you do not have all necessary rights and licenses;
6. upload, post, transmit, publish or distribute any material which infringes, violates, breaches or otherwise contravenes the rights of any third party, including any copyright, trademark, patent, rights of privacy or publicity or any other proprietary right;
7. interfere with or disrupt the use of the Website by any other user, nor "stalk", threaten, or in any manner harass another user;
8. upload, post, transmit, publish, or distribute any material or information which contains a computer virus, or other code, files or programs intending in any manner to disrupt or interfere with the functioning of the Website, or that of other computer systems;
9. use the Website in such a manner as to gain unauthorized entry or access to the computer systems of others;
10. upload, post, transmit, publish or distribute any material or information which constitutes or encourages conduct that would constitute a criminal offence, give rise to other liability, or otherwise violate applicable law;
11. upload, post, transmit, publish, or distribute any material or information that is unlawful, or which may potentially be perceived as being harmful, threatening, abusive, harassing, defamatory, libellous, vulgar, obscene, or racially, ethnically, or otherwise objectionable;
12. reproduce, copy, modify, sell, store, distribute or otherwise exploit for any commercial purposes the Website, or any component thereof (including, but not limited to any materials or information accessible through the Website);
13. use any device, software or routine to interfere or attempt to interfere with the proper working of the Website;
14. take any action that imposes an unreasonable or disproportionately large load on the Website infrastructure;
15. any interpretation of test results or study material other than as a tool of learning and enhancing knowledge; or
16. the tests and exercises are created for you to test your understanding of concepts and are not to be interpreted as a sample question paper for any examinations.

Any content uploaded by you on the Website shall be subject to relevant laws and may be disabled and/or may be subject to investigation under appropriate laws. Furthermore, if you are found to be in non-compliance with the laws and regulations, these terms, or the privacy policy of the Website, We may terminate your account/block your access to the Website and We reserve the right to remove any non-compliant content uploaded by you on the Website.

We reserve the right to remove any content or links that allegedly infringes any other person's copyright at any point of time.

We will only collect, process, use and share your personal and/or non-personal information in accordance with our Privacy Policy. By using our Software and/or Services, you give your consent to us collecting, processing, using and sharing your personal and non-personal data in this way.

If you do not agree to our Privacy Policy you should not access and/or use our Software and/or Services.

When you use our Software and/or visit our website(s) or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

All content included in the Software and on this Website, such as questions, answers, lessons, other textual material, graphics, logos, button icons, images, audio clips, videos, digital downloads, data compilations, and software, is the property of mPaathShaala or its licensors and is protected by Indian and International copyright laws. The compilation of all content on this site is the exclusive property of mPaathShaala, with copyright authorship for this collection by mPaathShaala, and protected by Indian and International copyright laws.

Copyright Infringement

All the content including videos and study material are either licensed from multiple content partners or owned by mPaathShaala. Although every effort is made to ensure that mPaathShaala licenses original content from its content partners, mPaathShaala will not be held responsible if any of the licensed content violates the intellectual property rights of any third party. However, we are happy to discuss this with our content partners and resolve the issue if brought to our notice.

In the event you have any grievance in relation to any content, you can contact us at support@mpaathshaala.com. Please include the following information in your complaint -

• A physical or electronic signature of a person authorized to act on behalf of the copyright owner for the purposes of the complaint.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material on our website (or software) that is claimed to be infringing or to be the subject of infringing activity.
• The address, telephone number or e-mail address of the complaining party.
• A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
• A statement, under penalty of perjury, that the information in the notice of copyright infringement is accurate, and that the complaining party is authorized to act on behalf of the owner of the right that is allegedly infringed.

There may be third party information, advertisement, links and schemes displayed on the Website and/or in the Software through in-App advertisements. We do not monitor or control the linked sites and make no representations regarding, and are not liable or responsible for the accuracy, completeness, timeliness, reliability or availability of, any of the content uploaded, displayed, or distributed, or products, or services available at these sites. If you choose to access any third-party site, you do so at your own risk. When you provide data to such third parties you are providing it in accordance with their privacy policy (if any) and our own privacy policy does not apply in relation to that data.

The presence of a link to a third-party site does not constitute or imply our endorsement, sponsorship, or recommendation of the third party or of the content, products, or services contained on, or available through, the third-party site.

We reserve the right to disable links from or to third-party sites.

THE SOFTWARE AND SERVICES ARE PROVIDED BY US ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DISCLAIM ALL IMPLIED WARRANTIES.

mPaathShaala and its associates attempt to be as accurate as possible in the content and information provided. However, mPaathShaala does not warrant that the content is accurate, complete, reliable, current or error-free. We explicitly disclaim any responsibility for the correctness, accuracy, completeness or availability of information, content and materials found on sites that link to or from our Website(s). We cannot ensure that you will be happy with any products or services that you purchase from a third-party website that links to or from our Website(s) or third-party information, content or materials contained on our Website(s).

You acknowledge and agree that we make no warranty or condition of any kind, either express or implied, statutory or otherwise, with respect to the Software and Services including, but not limited to, the implied warranties or conditions of merchantability and fitness for a particular purpose and that the user assumes the entire risk as to the use and performance of the Software/Services.

In no event shall we and/or our affiliated and related companies, and their officers, directors and agents be liable to the user or any other person for any direct, indirect, special, consequential or incidental damages (including without limitation, damages for loss of revenues or profits, business interruption, loss of business information, and the like) arising out of the use or inability to use the Software and/or Services, including any viruses or other problems of any nature or kind whatsoever, all of which such risks the user voluntarily assumes.

In no event will our liability to you, whether in contract, tort (including negligence), or otherwise, exceed the amount paid by you for Software/Services under this Agreement.

You understand that we may update the Software, Website and/or the Content provided at any time, but are under no obligation to inform you of or furnish to you any such updates. This Agreement does not grant you any right, license or interest in or to any support, maintenance, improvements, modifications, enhancements or updates to the Software, Services or supporting documentation. If we supply any updates to you, such updates will be subject to the terms of this Agreement unless indicated otherwise.

This Agreement is effective from the first date You install the Software and/or use any of our Service. You may terminate this Agreement at any time by permanently deleting, destroying, and returning, at Your own costs, the Software, all backup copies, and all related materials provided by us. Your end-user rights automatically and immediately terminate without notice from us if You fail to comply with any provision of this Agreement. In such an event, You must immediately delete, destroy, or return at Your own cost, the Software, all backup copies, and all related material to us.

We reserve the right to update these terms from time to time by posting the updated version on our website. We may do so because we change the nature of our products or services, for technical or legal reasons, or because the needs of our business have changed. You agree that if you do not accept any amendment to our terms then you shall immediately stop accessing and/or using our Software and/or Services.
